• Department of Homeland Security offers relief to binational same-sex couples

    For years now, the Obama administration has focused immigration enforcement on criminals and fugitives rather than those who pose no risk. Under the policy of “prosecutorial discretion,” immigration officials can consider “ties and contributions to the community, including family relationships” when considering whether to take action to remove a person from the U.S.

    Last month, Homeland Security Secretary Janet Napolitano issued a letter clarifying that long-term, same-sex partners of American citizens can be included under this policy. It’s not a new policy, but it’s an important clarification that could make a big difference for LGBT couples—and it will ensure that immigration officials focus on those who threaten our communities rather than breaking up couples in committed relationships.
